We are the data controller for the personal data described in this policy. We process personal data in accordance with the data protection laws of The Commonwealth of The Bahamas and, where applicable to visitors from the European Economic Area and the United Kingdom, the EU General Data Protection Regulation (GDPR) and UK GDPR.

02What we collect
We only collect personal data you give us or that arises from your use of this website:
- Booking data: name, email address, phone number, party details (including children's ages where relevant for pricing and safety), booking date, package, payment confirmation. Payment card details are processed directly by our payment provider and are not stored on our servers.
- Contact and enquiry data: whatever you send us through the contact form, by email, by phone or by WhatsApp, including event and wedding enquiries.
- Newsletter data: your email address and, if you provide it, your name.
- Health and safety information: anything you tell us about medical conditions or limitations relevant to taking part safely in water activities. We treat this with particular care, use it only for safety purposes, and delete it after your visit.
- Technical data: server log files (browser type and version, operating system, referrer URL, host name, time of request) collected automatically for security and stability. This data is not merged with other sources and is not used to identify you.
- Cookie and marketing data: as described in our Cookie Policy.
03Why we use it, and on what legal basis
- To handle your booking and your visit: confirmations, tickets, check-in, safety, on-island service, refunds. Legal basis: performance of a contract.
- To answer your enquiries: contact form, email, phone, event and wedding requests. Legal basis: performance of a contract or steps prior to entering one, and our legitimate interest in responding to you.
- To send our newsletter: only if you signed up. Legal basis: your consent, which you can withdraw at any time using the unsubscribe link in every email.
- To run, secure and improve this website: server logs, error monitoring, aggregate statistics. Legal basis: our legitimate interest in a secure, functioning website.
- To advertise our experiences: analytics, remarketing and ad measurement as described in our Cookie Policy, only where you have consented via the cookie banner. Legal basis: your consent.
- To comply with legal obligations: tax, accounting and record-keeping requirements. Legal basis: legal obligation.
We do not sell personal data, and we do not pass it to third parties for their own marketing.
04Who we share data with
We share personal data only with service providers who help us run the business, and only to the extent needed:
- our booking and ticketing platform and our payment processor, to process bookings and payments
- ferry and on-island operations partners, limited to guest manifests needed for check-in and safety
- IT, hosting and email providers
- Google and Meta for analytics and advertising, only with your cookie consent, as described in our Cookie Policy
- authorities, where the law requires it
Where you booked through a cruise line, Viator, GetYourGuide or another reseller, that party is an independent controller of the data you gave them, and their privacy policy applies to that relationship.
05International transfers
We are based in The Bahamas, so if you contact us from abroad, your data is transferred here as part of fulfilling your booking. Some of our service providers (for example Google and Meta) process data in the United States. Where GDPR applies, such transfers rely on recognized safeguards, including the EU-U.S. Data Privacy Framework and the European Commission's Standard Contractual Clauses.
06How long we keep it
We keep personal data only as long as needed for the purpose it was collected for, and afterwards only as long as legal retention obligations require. As a rule: booking and invoice data is kept for the statutory retention period, enquiry correspondence is kept as long as needed to handle the matter, newsletter data is kept until you unsubscribe, and health and safety notes are deleted after your visit.
07Your rights
You have the right to ask us, free of charge, for:
- access to the personal data we hold about you, its origin and recipients, and the purpose of processing
- correction of inaccurate data
- deletion of your data, where no legal obligation requires us to keep it
- restriction of processing and objection to processing based on legitimate interest
- portability of data you provided to us, where GDPR applies
- withdrawal of any consent at any time, with effect for the future
To exercise any of these rights, email info@pearlislandbahamas.com. If you are in the EEA or UK, you also have the right to lodge a complaint with your local data protection authority. In The Bahamas, the supervisory authority is the Office of the Data Protection Commissioner.
08Security
This website uses SSL/TLS encryption throughout. You can recognize the encrypted connection by "https://" and the lock icon in your browser bar. Data you submit through our forms cannot be read by third parties in transit. We also apply technical and organizational measures to protect stored data against loss, misuse and unauthorized access.
09Children
Our website and marketing are directed at adults. We do not knowingly collect personal data from children online. Children's details (such as age bands for pricing) are provided by the accompanying adult as part of a booking.
10Website content and external links
We take care to keep the information on this website current, correct and complete, but we cannot guarantee it, and all offers are subject to change. Where this website links to external websites, the operators of those sites are solely responsible for their content. At the time of linking, no unlawful content was identifiable to us; we have no influence on the current or future design and content of linked pages.
All content, design, photography and text on this website are the property of Pearl Investment Management Group Ltd. unless otherwise indicated, and may not be reproduced without our written consent. Use of the contact details published on this website for sending unsolicited advertising is not permitted.
11Changes to this policy
We may update this policy from time to time, for example when we change service providers or when the law changes. The version published on this page is the version in force.
